台灣在民國55年前由於國家發展重點在於經濟與國防,忽略對古蹟保存的重要性,僅只任其發生。其後由於受大陸「文化大革命」影響,在中華固有文化與文物大量 流失情況下,政府開始關切並保存文化資產,但礙於國家情勢難以徹底落實。在經過60-70年代工業發展創造台灣經濟奇蹟,社會財富充裕情況下,民眾逐漸開 始重視文化生活,政府也正視文化保存問題,將「文化建設」列入十二項建設中,積極研擬相關政策與法令,重視文化資產保存。台灣在經過工業化與經濟成長的雙 重影響而加速都市化現象,使都市中古蹟用地劃設產生問題,除此之外,也因法令的缺乏遭遇許多困境。古蹟具有歷史意義公共文化財,基於都市整體發展需求,若 以公共福利的立場須以公權力的方式加以劃設與保護;但反觀以保障私有權益觀點論,以強制力方式對私有財產加以劃設為保存區並限制其發展的權益,卻明顯違背 公平性並限制憲法中人人有自由擁有財產的權利,忽略考慮古蹟私有權益公平性。 過去許多古蹟用地劃設研究中,許多學者在解決古蹟用地劃設方法之研究多有貢獻,以及古蹟保存技術與政策面也提出許多不同的寶貴意見,但卻鮮少以歷史與權利 理論上觀點,釐清古蹟用地劃設的權益。僅有少數以私有權益為觀點為基礎,運用土地使用的方式探討保存方式,但也僅限於初步分析,卻無建構古蹟用地劃設權益 的模式。由此觀之,由於對「古蹟用地劃設權益」基本概念模糊,導致目前處理古蹟用地劃設方式,難有統一公平原則與標準原因,更遑論古蹟用地劃設權益的公平 性,故忽略對私有權益合理與公平考量,僅依照既有法令相關規定辦理。故為有別於以往的研究,本研究在解決古蹟用地劃設僵化無彈性作法上,提出本研究主要目 的包括:以權利理論與歷史觀點探究古蹟所有權歸屬,釐清台灣古蹟用地劃設問題;探討台灣古蹟用地公私權益之衝突,及對於因劃設對古蹟私有權益影響的程度, 最後研擬古蹟用地劃設方式,以達到公私權益間均衡。總之,希望嘗試突破舊有欠缺整體規劃作法,研擬有彈性的策略以處理古蹟用地劃設問題,朝向雙嬴(社會福 利與私有權益)的策略妥善研究解決之道。在建構古蹟用地劃設公私均衡模式後,希望能在重視古蹟保存社會意義同時,亦能顧及私有權益的保障,促使未來都市整 體的發展過程,古蹟用地劃設方式對社會與私有權益間,達成調和境界決策重要參考之依據。

Before 1966 in Taiwan, government paid more attention on development of economics and army, but ignored the importance of preservation of historical buildings. Until Mainland China destroyed traditional culture and antiquity in China, Taiwan government became take care to preserve them but the job of preservation of historical buildings still could not fulfill completely. Under the fast change of society and economics 1970 to 1980 in Taiwan, people became rich and wish to pursuit better cultural life. Therefore government study and engage some culture police and law to preserve historical buildings. In order to urbanize and without proper law, there are many historical buildings could not preserve impeccably in Taiwan. Due to historical buildings are public goods, so government must preserve historical buildings in order to raise society fairness. On the other hand, people have to rights to use and dispose their own proprietary freely in the constitution and historical buildings owners should have the land rights also. So there is serious conflict of rights between public and private. If land right of historical buildings belongs to public, government should seek the best benefit in order to care most people in society. The way is to let land rights of historical buildings used and redeveloped propriety. On the contrary, if it belongs to private, we consider balance between social welfare and private benefit, and government should respect rights of owners. Under people\'s rights without influence situation, government could let people use fitness. Thus rights of owners would treat fairly. In the past most of discussion focus about legislation and methodology of preservation of historical buildings zone, but it lacked philosophy. A few studies to measure impact that damages of historical relic owners after there preserving historical buildings area. Therefore, we try to use different way in philosophy to make these complex problems easy and to measure the impact. Besides establish model of preservation of historical relic zone propriety. This study had defined historical relic and discuss theory of rights, besides to seek some preservation of historical relic zone problems in Taiwan. To measure that the owners lose rights after setting antiquity zone and trying to establish the principle of equity preserving historical relic zone. To sum up, the way to preserve historical buildings should be pay more elasticity and liveliness, than it can converge principle of fairness. To preserve historical buildings that are a job that must consider to combine urban plan and development. After establish proper model it could make city to develop well. Not only preservation could not deter city development, but also help planner to create new specific space. This way can bring more comfortable, cultural space to citizenry. It also can prompt city become more attraction in the future.
